Acceptance of Terms
By accessing and using the Qovdine platform (www.qovdine.com), operated by Qovdine SpA, Tax ID (RUT) 77.234.567-8, domiciled at Av. Apoquindo 4700, Office 1201, Las Condes, Santiago, Chile, you accept these Terms and Conditions in their entirety. If you disagree with any part of these terms, please do not use the platform.
Service Description
Qovdine is a real estate crowdlending platform that facilitates the connection between investors and real estate development projects in Chile. The platform allows users to collectively contribute funds to finance specific construction, renovation, and urban development projects, receiving in return a proportional share of the profits generated.
Eligibility Requirements
To use Qovdine's investment services, you must: be over 18 years of age; be a tax resident in Chile or hold a valid Tax ID (RUT); provide truthful and complete information during registration; have a bank account in your name at a regulated financial institution in Chile. Qovdine reserves the right to request additional documentation to verify your identity and comply with anti-money laundering regulations.
Investment Conditions
All investments made through Qovdine are subject to risk. Past returns do not guarantee future results. The minimum investment amount per project will be individually determined for each opportunity and will be clearly indicated in the project file. Qovdine does not guarantee the profitability of any project nor is it responsible for losses that may arise from investments made.
User Obligations
The user commits to: using the platform solely for its intended purposes; maintaining the confidentiality of access credentials; not engaging in activities that may damage, disable, or overload the platform; providing up-to-date and truthful information; and complying with all applicable tax and financial regulations.
Intellectual Property
All content on the platform, including texts, graphics, logos, images, software, and source code, is the property of Qovdine SpA and is protected by Chilean intellectual property laws and international treaties. Its reproduction, distribution, or modification without express written authorization is prohibited.
Limitation of Liability
Qovdine acts exclusively as an intermediary between investors and real estate developers. We assume no responsibility for: delays or breaches in project execution; variations in projected returns; changes in regulations affecting investment conditions; indirect, incidental, or consequential damages arising from the use of the platform. Qovdine's total liability in any case shall not exceed the amount of commissions actually charged to the user.
Termination
Qovdine may suspend or cancel your account if you breach these Terms and Conditions, provide false information, or engage in suspicious activities. In case of termination, existing investments will be honored in accordance with their specific conditions.
Applicable Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Chile. Any dispute shall be submitted to the jurisdiction of the ordinary courts of justice of Santiago, Chile, with the parties waiving any other venue that may correspond to them.
Modifications
Qovdine reserves the right to modify these Terms and Conditions at any time. Modifications will be communicated through publication on the platform and email to registered users at least 30 days in advance.
